Privacy policy of Fundacja Atlas Sztuki

1. Personal data protection policy

PROCESSING OF PERSONAL DATA

This policy concerns the processing of personal data of Users of:

• websites operated by Fundacja Atlas Sztuki, i.e. https://atlassztuki.pl/; https://5inlodz.pl/; https://6inlodz.pl/; https://promised.pl/ and others.

Personal data means any information relating to an identified or identifiable natural person (“data subject”) within the meaning of the GDPR.

All personal data is collected and processed by the personal data Controller—Fundacja Atlas Sztuki—in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, GDPR), the Act of 18 July 2002 on Providing Services by Electronic Means and the Act of 16 July 2004, Telecommunications Law.

Providing personal data through the forms available on the websites
of Fundacja Atlas Sztuki is not mandatory, which means that Users provide their personal data voluntarily. Providing personal data is, however, necessary in order to join the Fundacja Atlas Sztuki projects Rewriting The Promised Land and 6inLodz and/or to send a message to Fundacja Atlas Sztuki. When registering or applying to participate in a project, you will be asked to provide only the personal data necessary for the purpose concerned.

When joining a project organised by Fundacja Atlas Sztuki, each User should read the terms and conditions and declare that they have read and accept them.

Some forms also offer the option of consenting to the use of telecommunications terminal equipment and to other activities whose purposes are specified in the form concerned and whose scope reflects the nature of the relevant programme, portal or activity.

Each form through which Fundacja Atlas Sztuki obtains Users’ personal data contains detailed information about the personal data controller(s), the purposes and methods of processing, the recipients of personal data and the rights available to Users. The scope of this information is tailored to the form concerned.

The data provided is protected against third-party access and processed
by Fundacja Atlas Sztuki solely for the purposes specified in the respective forms.

SCOPE OF PERSONAL DATA PROCESSED

For registration in a project run by Fundacja Atlas Sztuki, Fundacja Atlas Sztuki obtains and processes Users’ personal data appropriate to the activity concerned. The data is used for technical purposes connected with server administration. IP addresses are also used to compile general statistical demographic information about visitors to the above-mentioned websites operated for Fundacja Atlas Sztuki.

WEBSITE USAGE ANALYTICS

The Website uses its own first-party measurement of how visitors use its pages. This measurement covers the page opened, active viewing time, interactions with the 5inLodz project banner, terms entered in the internal search tool and search results clicked. This analytics dataset does not store IP addresses or full browser identifiers and is not shared with an external analytics provider. A random identifier stored only in the browser's session storage is used to connect events within a single open tab. Events are retained for no more than 35 days and are used to improve the Website's structure, content and operation.

PURPOSES OF PERSONAL DATA PROCESSING

Users’ personal data is obtained, collected, stored and used by Fundacja Atlas Sztuki in connection with acceptance of a project’s terms and conditions or consent to data processing for the purposes specified in that consent. Fundacja Atlas Sztuki processes personal data lawfully, in accordance with the appropriate procedures and in a manner that ensures its security.

Fundacja Atlas Sztuki may use personal data solely to answer a question or carry out a project, provided that the User has consented to the processing of their data for that purpose.

The Controller also processes Users’ data in pursuit of the Controller’s legitimate interest in the direct marketing of its own goods or services—until the User objects to the processing of their data for this purpose.

The use of selected communication tools requires consent to the processing of personal data for a specified purpose. Consent may be given when a User account is registered.

USERS’ RIGHTS

Each User may submit a request directly to Fundacja Atlas Sztuki for access to their data, its rectification or erasure, restriction of its processing or a copy of the data. A User may also object to the processing of personal data concerning them and exercise their right to data portability.

To exercise their rights concerning the processing of personal data, any User whose data is processed by Fundacja Atlas Sztuki may contact the Data Protection Officer by email at biuro@atlassztuki.pl or by post at: Fundacja Atlas Sztuki, ul. Włókiennicza 20, 90-211 Łódź, marked “for the attention of the Data Protection Officer”.

Users may contact the data controller by email at biuro@atlassztuki.pl, by other means of remote communication or by post at the address of the data controller’s registered office.

In addition, Users participating in a Fundacja Atlas Sztuki project may exercise their right to access and rectify personal data provided to Fundacja Atlas Sztuki by sending a request to biuro@atlassztuki.pl, by other means of remote communication or by post at the address of the data controller’s registered office.

If a User participating in a Fundacja Atlas Sztuki project sends Fundacja Atlas Sztuki a request to erase their personal data, this is equivalent to withdrawing from the project.

Any User who has consented to the processing of their personal data for a specific purpose may withdraw that consent at any time. Withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal.

A User also has the right to lodge a complaint with the President of the Personal Data Protection Office if they consider that the processing of personal data concerning them infringes the GDPR.

PERSONAL DATA PROFILING

Users’ personal data processed by Fundacja Atlas Sztuki is subject to standard profiling. Fundacja Atlas Sztuki does not make decisions concerning Users that are based on automated processing, including profiling, or decisions that produce legal effects concerning Users or similarly significantly affect them.

Profiling concerns, in particular, place of residence, geolocation and assignment to an appropriate age group. Its purpose is to tailor the Controller’s offering to Users’ needs.

PROTECTION OF PERSONAL DATA PROCESSED

The collected personal data is treated as a highly secure database and stored on a server protected against both remote (digital) and physical access. Fundacja Atlas Sztuki has implemented appropriate technical and organisational measures to ensure a level of security appropriate to the risk of infringement of Users’ rights and freedoms. Furthermore, all persons who process Users’ personal data hold the appropriate authorisations issued by the personal data Controller in accordance with Article 29 of the GDPR.

DISCLOSURE OF PERSONAL DATA

Fundacja Atlas Sztuki does not transfer (sell or otherwise make available) the personal data it has collected about Users to third parties. Any data that Fundacja Atlas Sztuki may disclose to entities with which it cooperates takes the form of general statistical summaries that do not permit individual Users to be identified. For technical reasons and without changing the processing purpose specified above, Fundacja Atlas Sztuki may entrust processing to another entity under a contract or other legal instrument pursuant to Article 28 of the GDPR.

TRANSMISSION SECURITY

Data of particular importance—passwords of any kind in particular—is transmitted using the encrypted SSL protocol.

COOKIES

The Website does not automatically collect any information other than information contained in cookies and system logs (e.g. an IP address). Cookies are digital data, in particular text files, stored on a Website User’s terminal device and intended for use with the Website’s pages. Cookies usually contain the name of the website from which they originate, their storage period on the terminal device and a unique number. The entity that places cookies on the Website User’s terminal device and obtains access to them is Fundacja Atlas Sztuki, the operator

PURPOSES FOR WHICH COOKIES ARE USED

Fundacja Atlas Sztuki uses cookies for the following purposes:

  1. a) to adapt the content of the Website’s pages to the User’s preferences and optimise their use of those pages; in particular, these files make it possible to recognise a Website User’s device and display the website appropriately, tailored to their individual needs;
  2. b) to compile statistics that help explain how Website Users use the pages, making it possible to improve their structure and content;
  3. c) to maintain a Website User’s session (after logging in), so that the User does not have to re-enter their username and password on every page of the Website.

TYPES OF COOKIES

The Website uses two principal types of cookies: session cookies and persistent cookies. Session cookies are temporary files stored on a User’s terminal device until they log out, leave the website or close the software (web browser). Persistent cookies are stored on a User’s terminal device for the period specified in the cookie parameters or until they are deleted by the User.

The Website uses the following types of cookies:

MANAGING COOKIES

In many cases, software used to browse websites (a web browser) allows cookies to be stored on a User’s terminal device by default. Website Users may change their cookie settings at any time. In particular, these settings may be changed to block the automatic handling of cookies in the browser settings or to notify the User each time cookies are placed on the Website User’s device. The Website Operator advises that restrictions on the use of cookies may affect some functions available on the Website’s pages. HOW TO DISABLE COOKIES

In Mozilla Firefox

From the Tools menu, select Options and then the Privacy tab. The browser lets you indicate that you do not wish to be tracked at all or delete individual cookies from particular websites.

In Microsoft Internet Explorer

From the Tools menu, select Internet Options and then the Privacy tab. You can use the slider to adjust the general level of privacy or use the Sites button to manage settings for individual websites.

In Google Chrome

From the menu concealed behind the three horizontal lines in the top right-hand corner of the browser, select Tools and then Clear browsing data…. In addition to the option of clearing cookies, there is a More information link leading to a detailed description of the browser’s privacy features.

In Opera

Use the Opera button in the top left-hand corner to open the menu, select Settings and then Clear browsing history…. In addition to the option of deleting cookies that have already been set, there is a Manage cookies… button leading to more advanced options for individual websites.

In Apple Safari

From the Safari menu, select Preferences and then the Privacy tab. There you will find a range of cookie options.

On mobile phones, tablets and other mobile devices
